UPERC Empowers Solar Energy Adoption with Landmark Amendment to Rooftop Solar Net Metering Regulations 2019

In a significant development aimed at promoting sustainable energy practices, the Uttar Pradesh Electricity Regulatory Commission (UPERC) has introduced the UPERC (Rooftop Solar PV Grid Interactive System Gross/Net Metering) Regulation, 2019 (Second Amendment). This amendment, published via notification no. UPERC./Secretary/RSPV Regulations on June 1, 2022, reflect the commitment to harnessing solar energy in the state.

This move comes in the wake of the Uttar Pradesh government’s proactive stance on solar energy, as outlined in the UP Solar Policy 2022. This policy, designed to remain in operation for five years or until the government notifies of a new policy, underscores the state’s dedication to renewable energy sources.

The UPERC’s authority to enact such regulations stems from its powers granted by Sections 61, 86(1)(e), and 181 of the Electricity Act, 2003, along with other enabling powers. The newly introduced UPERC (Rooftop Solar PV Grid Interactive System Gross/Net Metering) Regulation, 2019 (Second Amendment) is poised to make a lasting impact on the integration of solar power into the state’s energy landscape.

Under the Net Metering Scheme outlined in the amendment, prosumers falling under agriculture (LMV-5) and domestic consumers under LMV-1 categories are eligible. This scheme facilitates the installation of grid-connected rooftop solar PV systems, whether self-owned or third-party-owned, enabling the seamless integration of energy from the grid and surplus energy generated by the rooftop solar system. This process involves the use of a single bi-directional energy meter to net out imported and exported energy.

Furthermore, the amendment extends the Net Metering Scheme to various consumer categories mentioned in the Rate Schedule for FY 2023-24 in Tariff Orders dated May 24, 2023, of Distribution Licensees (MVVNL, PVVNL, PuVVNL, DVVNL, KESCO & NPCL). Public institutions under LMV-4A and Private research institutes, schools, colleges, and educational institutes under Private Institutions under LMV-4B are included. Additionally, Public Institutions and Private Institutions akin to those mentioned above but covered under the HV-1 consumer category of Rate Schedule also benefit from the Net Metering Scheme. In essence, the UPERC’s forward-looking amendment reflects a concerted effort to encourage the adoption of solar energy in Uttar Pradesh, aligning with the state’s broader vision for a sustainable and environmentally conscious energy future. The regulations are set to come into force from the date of their notification in the Official Gazette of the State, marking a significant step towards a greener and more energy-efficient Uttar Pradesh.
