M/s. Shivman Wind Energy Private Ltd. has filed a petition before the Gujarat Electricity Regulatory Commission (GERC) seeking an extension for the commissioning of its transmission network linked to a 70 MW Hybrid Power Plant being developed near Dwarka, Gujarat. The petition, registered as Petition No. 2458 of 2025, was filed against the Gujarat Energy Transmission Corporation Ltd. (GETCO). Shivman Wind Energy has claimed that multiple delays beyond its control, which it argues fall under the category of Force Majeure events, have prevented the timely completion of the project.
The company’s primary request is for an extension of the Scheduled Date of Commissioning (SCOD) for the evacuation infrastructure designed to connect its project to GETCO’s 220/66 kV Bhatiya Sub-Station. Shivman Wind Energy has outlined several reasons behind the delays, citing both natural events and procedural hurdles.
The first major delay, the company noted, was due to Cyclone Biparjoy, which affected the project between June 24, 2024, and August 30, 2024. This event alone accounted for 68 days of delay. After this, the company claimed that GETCO’s inability to provide the necessary right-of-way (ROW) for the transmission network caused an additional delay of 91 days, spanning from August 30, 2024, to November 28, 2024.
In addition to these issues, the petitioner highlighted a delay of 76 days between October 4, 2024, and December 19, 2024, attributing it to unforeseen circumstances. A much larger setback, however, arose from local agitation and disputes raised by villagers, which began on December 27, 2024. According to the petition, this agitation had continued at the time of the written submission in May 2025, amounting to 139 days of delay. The company emphasized that such disputes, which directly obstruct the creation of the transmission network, were completely outside its control.
The company also pointed to delays on the part of GETCO itself. According to Shivman Wind Energy, GETCO’s delay in conducting a Kick-off meeting and granting approval for the extension of the transmission system caused another 77 days of delay, from August 7, 2024, to October 23, 2024. Taken together, these delays have significantly impacted the project timeline and hindered progress in completing the transmission system needed to evacuate power from the hybrid plant.
Based on these factors, Shivman Wind Energy has requested an extension of 192 days for commissioning the transmission network and associated system. The company stated that the combination of natural disasters, procedural delays, and social disputes clearly qualifies as Force Majeure, making them eligible for relief.
The petition now lies with the Gujarat Electricity Regulatory Commission, which will examine the claims and decide on the eligibility of the requested extension. The decision will determine whether Shivman Wind Energy receives the additional time it has asked for to complete the transmission network and move forward with the commissioning of its 70 MW Hybrid Power Plant. The outcome will also highlight how regulatory bodies evaluate such complex disputes involving developers, state transmission utilities, and local challenges.
