Following the passage of Illinoisโ Energy Omnibus Bill, officials from Grundy County and ECA Solar confirmed that the updated statutory language reinforces the countyโs authority over solar project siting in unincorporated areas of Morris.
Grundy County Stateโs Attorney Russ Baker emphasized that the county adhered to its established review procedures throughout the evaluation of the proposed solar project.
“While we respect the city of Morris’ position, we were surprised Morris decided to pursue litigation,” said Russ Baker, State’s Attorney for Grundy County. “The proposed solar development is located outside city limits and within Grundy County’s jurisdiction, and the County’s approval process was conducted lawfully and in accordance with all applicable zoning and procedural requirements.”
The Energy Omnibus Billโexpected to be signed by Governor JB Pritzkerโamends the Illinois Counties Code to clarify that counties have authority to regulate the siting of commercial solar facilities in unincorporated areas outside municipal zoning boundaries.
