GERC Allows Withdrawal Of 70 MW Wind-Solar Hybrid Project Petition After New Tariff Order Impact

The Gujarat Electricity Regulatory Commission (GERC) has concluded a legal proceeding related to a 70 MW solar-wind hybrid power project in Gujarat. The matter was brought before the Commission by Renew Green Energy Solutions Pvt. Limited against Gujarat Energy Transmission Corporation Limited (GETCO) and Gujarat Energy Development Agency (GEDA).

The company had approached the Commission under Section 86 of the Electricity Act, 2003. In its petition, the company requested an 18-month extension to complete its renewable energy project. Along with the main petition, it also filed an interlocutory application seeking an interim stay against the encashment of a bank guarantee of Rs 2.1 crore. This bank guarantee had been submitted to GETCO as part of the projectโ€™s infrastructure and grid connectivity requirements.

During the hearing held on February 20, 2026, the counsel for the petitioner informed the Commission about an important development that affected the case. The Commission had earlier issued a new Wind Solar Hybrid Tariff Order (No. 01 of 2024) on February 22, 2024. This order introduced a revised tariff framework for hybrid renewable energy projects in the state. The new tariff order was made applicable retrospectively from June 20, 2023.

According to the petitioner, their project was not commissioned before the June 2023 deadline. As a result, the project came under the provisions of the 2024 Tariff Order instead of the earlier tariff framework. This change meant that some benefits available under the previous tariff structure were no longer applicable to the project. In view of this regulatory shift, the company decided not to continue with the case.

The petitioner submitted an affidavit before the Commission seeking unconditional withdrawal of both the main petition and the stay application. The legal representative of GETCO stated that the respondent had no objection to the withdrawal request.

The Commission, headed by Chairman Pankaj Joshi along with members Hiren Shah and Jatin N. Thakkar, considered the submissions made by both parties. In its final order dated February 21, 2026, the Commission allowed the unconditional withdrawal of the petition. Accordingly, Petition No. 2335 of 2023 and the related interlocutory application were dismissed as withdrawn. With this order, the proceedings concerning the extension of the 70 MW solar-wind hybrid project and the encashment of the bank guarantee have come to an end.
