GERC Disposes Of The 11.2 MW Solar Project Extension Petition After Earlier Regulatory Relief In Gujarat

Icon Granito Private Limited has withdrawn its petition before the Gujarat Electricity Regulatory Commission (GERC) after the regulatory relief it had sought was already granted through an earlier order of the Commission. The decision was recorded in Petition No. 2568 of 2025 by a GERC bench comprising Chairman Pankaj Joshi and Members Hiren Shah and Jatin N. Thakkar in an order issued on August 4, 2026.

The case related to a connectivity agreement signed on October 1, 2024, between Icon Granito Private Limited and Gujarat Energy Transmission Corporation Limited (GETCO). Under the agreement, the company planned to connect its 11.2 MW ground-mounted solar power project located in Junagadh to GETCO’s 66 kV Dhebar Substation at the 66 kV voltage level.

During the execution of the project, Icon Granito faced unforeseen and uncontrollable circumstances that delayed the commissioning of the remaining 4.70 MW capacity of the solar plant. As a result, the company approached the Commission seeking a six-month extension for commissioning the balance capacity, requesting that the deadline be extended until February 28, 2026.

In its petition, the company also requested the Commission to direct GETCO not to initiate any coercive action while the matter was under consideration. It sought protection against the cancellation of its connectivity or open access rights, the levy of relinquishment charges, and the encashment of its Performance Bank Guarantee until a final decision was taken.

However, during the hearing held on July 28, 2026, counsel appearing for Icon Granito informed the Commission that the relief sought in the petition had already been addressed through an earlier GERC order. The counsel referred to the Commission’s order dated January 21, 2026, in Petition No. 2564 of 2025, which had been filed by GETCO.

In that earlier proceeding, the Commission revised the timeline for commissioning evacuation lines for renewable energy projects with capacities of up to 100 MW. The permitted period was extended from 12 months to 18 months. The Commission had also clarified that the revised timeline would apply not only to future projects but also to all renewable energy projects that were under development and had not yet been commissioned.

Since Icon Granito’s Junagadh solar project qualified under the revised regulatory framework, the company was able to commission the remaining 4.70 MW capacity within the newly permitted 18-month period. As the project had become fully operational, the company informed the Commission that its petition no longer served any purpose and requested permission to withdraw it unconditionally. The company also undertook to file a formal affidavit confirming the withdrawal within one week.

Representatives of GETCO informed the Commission that the project was covered by the January 21, 2026 order and confirmed that the solar plant had already been commissioned. They stated that they had no objection to the unconditional withdrawal of the petition.

Taking note of the submissions made by both parties and the absence of any dispute, the Gujarat Electricity Regulatory Commission permitted Icon Granito Private Limited to withdraw the petition. The Commission disposed of the matter as unconditionally withdrawn, subject to the company filing its affidavit of withdrawal within seven days.
