The Assam Electricity Regulatory Commission (AERC) has issued a public notice proposing the Assam Electricity Regulatory Commission (Electricity Ombudsman) (Second Amendment) Regulations, 2026. The draft has been issued through Notice No. EOM.56/2023/76 and Notification No. EOM.56/2023/75 from the Commission’s office in Guwahati.
The proposed amendment seeks to modify the Assam Electricity Regulatory Commission (Electricity Ombudsman) Regulations, 2022, particularly the provisions governing the pay, allowances, and other benefits of the Electricity Ombudsman. The Commission has proposed the changes under Section 181 read with Sub-section (6) of Section 42 of the Electricity Act, 2003.
The key change relates to Regulation 6, which deals with the remuneration and benefits of the Electricity Ombudsman. Under the proposed substituted Clause 1, the remuneration will depend on whether the appointed Ombudsman is a retired pensioner.
For a retired pensioner appointed as Electricity Ombudsman, remuneration will be determined in accordance with the notifications, orders, or instructions issued by the Finance Department of the Government of Assam relating to the re-employment of pensioners. For an appointee who is not a retired pensioner, the remuneration will be equivalent to the pay and allowances last drawn immediately before taking charge as Electricity Ombudsman.
The proposed amendment also replaces Clause 2 of Regulation 6. Under the revised provision, other allowances and perquisites applicable to the Electricity Ombudsman will be determined by the distribution licensee or licensees, subject to approval by the Commission.
The amended regulations will come into force from the date of their publication in the Official Gazette of the Government of Assam.
As part of the statutory consultation process under Section 181(3) of the Electricity Act, 2003, AERC has made the draft regulations available on its official website for public review. The Commission has invited comments, objections, and suggestions from individuals, companies, and other entities that may be affected by the proposed amendments.
Stakeholders have been asked to submit their responses to the Commission on or before September 11, 2026. They are also required to provide soft copies of their submissions in both Word and PDF formats through the designated email address, [aerc_ghy@hotmail.com](mailto:aerc_ghy@hotmail.com).
The consultation will allow stakeholders to provide their views before the proposed amendments are finalized and notified.
