The Gujarat Electricity Regulatory Commission (GERC) has adjourned the hearing in Petition No. 2579 of 2025, filed by M/s Anand Liners (India) Pvt. Limited, to provide all parties additional time to complete their written submissions. The petition seeks clarification and an amendment to the state’s green energy banking provisions under the GERC (Terms and Conditions for Green Energy Open Access) Regulations, 2024.
The dispute relates to Regulation 17.6 (vi), which provides that consumers can bank energy equivalent to “at least 30%” of their total electricity consumption from their distribution licensee during a billing period. However, the regulation does not specify a maximum limit for the amount of energy that can be banked.
Anand Liners has approached the Commission seeking a clear upper limit under the provision. The petitioner has argued that the absence of a maximum ceiling creates ambiguity in the implementation and interpretation of the banking rules.
The matter was taken up during a hybrid hearing on September 2, 2026. During the proceedings, representatives of Gujarat Urja Vikas Nigam Limited (GUVNL) and Paschim Gujarat Vij Company Limited (PGVCL) informed the Commission that they had already submitted their respective replies. However, the petitioner had not yet filed rejoinders to those responses.
Counsel representing the Gujarat Energy Development Agency (GEDA) also informed the Commission that she had been newly appointed to represent the agency and that GEDA had not received a copy of the original petition. No representative appeared on behalf of the Government of Gujarat’s Energy & Petrochemicals Department during the hearing.
In response to the procedural issues, the petitioner’s legal representatives agreed to provide GEDA with the required petition documents. They also sought additional time to prepare and submit rejoinders to the replies filed by GUVNL and PGVCL.
Following the hearing, the Commission, comprising Chairman Pankaj Joshi and Member Jatin N. Thakkar, issued an order dated September 5, 2026, laying down a schedule for completion of the remaining pleadings.
Under the order, Anand Liners was directed to serve a copy of the petition on GEDA by September 5, 2026. GEDA has been granted time until September 28, 2026, to file its response before the Commission.
The petitioner has further been allowed to submit its final rejoinder to the replies filed by all respondents by October 3, 2026.
GERC has stated that the next hearing date will be communicated separately after all required pleadings are placed on record. The Commission’s decision could provide greater clarity on the permissible limits for green energy banking under Gujarat’s open access framework and help address the ambiguity surrounding the existing 30% provision.
