The Bihar Electricity Regulatory Commission (BERC) has initiated a suo-motu proceeding to formulate the Bihar Electricity Regulatory Commission (Renewable Purchase Obligation, its Compliance & REC Framework Implementation) (First Amendment) Regulations, 2026. The Commission is seeking stakeholder participation in the regulatory process and has extended the deadline for submitting comments, suggestions and objections to October 26, 2026.
The amendment aims to address the regulatory framework governing Renewable Purchase Obligations (RPO), compliance requirements and the implementation of the Renewable Energy Certificate (REC) framework in Bihar. The proceeding will provide an opportunity for stakeholders to share their views on the proposed changes before the Commission finalises the amendment.
As part of the consultation process, BERC had previously made the draft regulations available on its official website. The Commission also published public notices in leading newspapers, including The Times of India, Hindustan and Qaumi Tanzeem, inviting interested parties to submit their feedback, suggestions and objections.
Following the publication of the draft regulations, the Commission received initial submissions from several stakeholders. These included the Bihar Renewable Energy Development Agency (BREDA), Shri Vikash Kumar, Chief Minister’s Fellow from the Energy Department, and independent researcher Shri D.S. Nikam. Their participation forms part of the consultation process intended to gather different perspectives on the proposed regulatory changes.
During the recent hearing, representatives from North Bihar Power Distribution Company Limited (NBPDCL) and South Bihar Power Distribution Company Limited (SBPDCL), along with the Centre for Energy Regulation (CER) at IIT Kanpur, requested additional time to prepare and submit their comments. Considering these requests, BERC decided to extend the deadline for filing submissions to October 26, 2026. The revised deadline will apply to all interested stakeholders, allowing them additional time to examine the draft regulations and communicate their views to the Commission.
The Commission has scheduled the next hearing in the matter for November 5, 2026, at 11:30 AM. The proceedings will be conducted before a bench comprising BERC Chairman Amir Subhani, Member (Legal) P.S. Yadav and Member (Technical) Manoj Kumar.
The extension provides stakeholders with further time to assess the proposed amendment and contribute to the regulatory process. Their submissions will form part of the consultation before the Commission considers the matter further. The proceeding is relevant to renewable energy procurement and compliance arrangements in Bihar, as the state continues to implement its regulatory framework for renewable energy obligations and REC-related mechanisms.
