The Central Electricity Regulatory Commission (CERC) recently passed an order for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation of Simbhaoli Power Pvt Ltd.
Simbhaoli Power Pvt Ltd , a renewable energy generator has filed the Petition under Conduct of Business Regulations andTerms and Conditions for recognition and issuance of Renewable Energy Certificate for Renewable Energy Generation against National Load Despatch Centre (NLDC).
Simbhaoli Power made the following prayers: To condone the delay in applying for issuance of REC due to it for the month of March, 2019 due to the Petitioner for energy injected, To Direct the Respondent to issue the REC due to the Petitioner for the month of March,2019.
Simbhaoli Power submitted that it is a renewable energy generator having two units. The first unit with a total installed capacity of 28 MW is situated at Simbhaoli (in Hapur district of UP) out of which 17 MW is registered under Renewable Energy Certificate (REC) mechanism whereas, the second unit with a total installed capacity of 16 MW is situated at Chilwaria out of which 12 MW which is also registered under REC mechanism. The project has been accredited by Uttar Pradesh New and Renewable Development Agency and the project has also been registered by NLDC.
On 24.09.2019 EIR for the month of March 2019 was approved by UPSLDC and the same was communicated to Simbhaoli Power on 30.09.2019.NLDC declined to accept the Petitioner’s application as the period of six months since generation month (March 2019) had lapsed.
The Commission observes that the delay in filing of the application was caused due to delay in approval of EIR by UPSLDC hence it states that the delay in submitting the application because of delay in approval by UPSLDC is procedural in nature..
It further orders that Simbhaoli Power RECs for the period of March 2019 should be issued and orders NLDC to process the case of Simbhaoli Power for issuance of RECs for the month of March 2019 after due verification.
