GERC Grants Partial Extension To Cleanmax Vayu For Project Commissioning Till March 2026

The Gujarat Electricity Regulatory Commission (GERC), based in Gandhinagar, has issued an important order in Petition No. 2527 of 2025, involving Cleanmax Vayu Private Limited as the Petitioner and the Gujarat Energy Transmission Corporation Ltd (GETCO) as the Respondent. The case centered on a request by Cleanmax Vayu for an extension of time to complete its entire evacuation infrastructure and commission the project. The company sought an extension until September 30, 2026, citing unforeseen challenges that delayed the project’s progress.

In addition to the main petition, Cleanmax Vayu had filed an Interim Application (IA No. 74 of 2025), seeking a stay or interim injunction and suitable interim orders. However, the Commission clarified that since the main petition was being taken up for final disposal, the Interim Application had become irrelevant. Consequently, it was declared infructuous and disposed of accordingly.

A major issue in the case was the delay in commissioning the project and the expenses incurred by the Petitioner. Cleanmax Vayu explained that the delays were caused by factors beyond its control, including the timeline for developing the common infrastructure and obtaining necessary approvals. The Commission, while noting the explanations, carefully examined each claim. It was observed that one of the reasons cited by the Petitioner could not be accepted due to the lack of adequate documentation and evidence to support the claim.

Despite rejecting that specific claim, the GERC took into account the overall project status and the detailed expenditure submitted by the Petitioner. The Commission noted that the total project cost stood at ₹19.18 crore, which increased to ₹22.63 crore after including 18% IGST. The expenditure covered key works related to the common evacuation infrastructure. This included ₹1.58 crore spent on the Supply, Installation, Testing, and Commissioning (SITC) of a 66 kV Bay at the Grid Substation (GSS), ₹11.09 crore for the SITC of a 50 MVA Power Sub-Station (PSS), and ₹5.56 crore for the SITC of a 66 kV SPDC Transmission Line. Additionally, the Petitioner had leased 80 acres out of 110 acres of land for ₹3.00 crore for the project’s development.

After reviewing the evidence, progress reports, and ongoing work, the GERC decided to grant partial relief to the Petitioner. The Commission allowed an extension for completing the project and its evacuation infrastructure, but did not grant the full period requested. Instead of the sought date of September 30, 2026, the Commission set the new deadline as March 31, 2026. This provides Cleanmax Vayu additional time to complete the remaining work and commission the project. The Commission directed all parties involved to follow the order and ensure timely compliance with the revised schedule.
