BERC Directs BSPGCL To Revise Tender Documents For 150 MW Solar Project With 300 MWh BESS In Bihar

The Bihar Electricity Regulatory Commission (BERC) has directed the Bihar State Power Generation Company Limited (BSPGCL) to submit corrected tender documents for a proposed 150 MW solar power project integrated with a 75 MW/300 MWh Battery Energy Storage System (BESS) in Bihar. The direction was issued during a hearing of Case No. 46/2026 held on November 2, 2026, concerning regulatory approval of the project’s bidding documents.

The proposed project aims to select solar power developers through a tariff-based competitive bidding process. BSPGCL has approached the Commission seeking approval for the Request for Selection (RfS) document and the draft Power Purchase Agreement (PPA), including project-specific provisions and proposed deviations. North Bihar Power Distribution Company Limited (NBPDCL) and South Bihar Power Distribution Company Limited (SBPDCL) have been named as respondents in the proceedings.

The petition has been filed under Section 63 and Section 86(1)(b) of the Electricity Act, 2003. The proceedings also involve compliance with the BERC (Framework for Resource Adequacy) Regulations, 2025, and the BERC (Renewable Purchase Obligation, its Compliance and REC Framework Implementation) Regulations, 2025. These regulatory provisions provide the framework for power procurement, resource planning and renewable energy obligations in the state.

The case follows an earlier order issued by the Commission on October 12, 2026, which identified certain queries and deficiencies in the submitted documents. In response, BSPGCL filed its submission on October 22, 2026, addressing the issues raised by the regulator. The company subsequently requested an urgent hearing through a letter dated October 23, 2026, resulting in the matter being listed for November 2.

The hearing was conducted by a three-member bench comprising Chairman Amir Subhani and members P.S. Yadav and Manoj Kumar. During the proceedings, legal counsel representing BSPGCL presented arguments and reiterated the explanations submitted earlier regarding the proposed project structure and deviations in the bidding documents. Representatives of both NBPDCL and SBPDCL were also present during the hearing.

After examining the submissions and arguments, the Commission observed that BSPGCL had not submitted updated and corrected versions of the RfS and draft PPA incorporating the modifications agreed upon during the proceedings. The Commission considered these revised documents necessary for further examination of the petition and the proposed procurement process.

Accordingly, BERC directed BSPGCL to submit the corrected RfS and PPA documents, incorporating all agreed modifications, by November 9, 2026. The Commission has scheduled the next hearing for November 12, 2026, at 11:30 AM, when the matter will be taken up for further consideration.
