Navigating Solar PV Module Procurement: Insights From Power Purchase Agreement Dispute Resolution

In a recent development regarding a petition concerning a Power Purchase Agreement (PPA), a hearing was held on January 3, 2024. The petitioner, representing a party involved in the PPA, submitted certain documents as directed by the Commission in a previous order dated August 10, 2023. These documents were deemed essential for verifying the petitioner’s claim related to a Change in Law. In response, the petitioner provided various invoices, bills of lading, packing lists, and other relevant documents supporting their claim.

However, the respondent, represented by GUVNL, expressed the need for additional time to verify the voluminous documents provided by the petitioner. They indicated that some documents were either missing or insufficient to establish the petitioner’s claim. In light of this, the petitioner’s counsel requested a two-week extension to reconcile the documents with the respondent.

During the hearing, the Commission raised inquiries regarding the procurement of solar modules and related matters. The petitioner assured the Commission that they would demonstrate their compliance with the necessary document submission and eligibility for receiving compensation as per the PPA terms.

Further scrutiny revealed discrepancies in the Module Supply Agreement between Renew Solar Energy Jharkhand (One) Pvt. Ltd. and Longi Solar Technology Company Limited. Certain documents, such as the flash report and certificate of origin, were found to be missing according to the agreement’s requirements. The petitioner’s counsel assured that the necessary documents would be submitted via affidavit to address these discrepancies.

In response to the Commission’s query about any recent discrepancies in the petitioner’s submissions, the respondent requested time to thoroughly examine the documents before filing a reply. The petitioner agreed to rectify any discrepancies and assured timely submissions.

The Commission emphasized the importance of ensuring all necessary documents and details are provided without delay. Both parties were given specific timelines for submitting their responses and were reminded of their responsibilities in supporting their respective claims.

The next hearing date will be communicated separately, as per the Commission’s order.
