MPERC Announces First Amendment To Balancing And Settlement Code, 2023

The Madhya Pradesh Electricity Regulatory Commission (MPERC) has introduced an amendment to the Madhya Pradesh Balancing and Settlement Code, 2023. This amendment, known as the “First Amendment to Madhya Pradesh Balancing and Settlement Code, 2023 (ARG-34(II)(i) of 2024),” will take effect from the date of its publication in the official Gazette of the Government of Madhya Pradesh.

The key changes include several updates to specific clauses of the Principal Code. First, Clause 6 has been amended. The term “each Discom” in Sub-clause (2) is now replaced with “each Intra State Entity (Excluding RE Generators, Hydro Generators and Open Access Customers).”

In Clause 7, there are multiple amendments. Sub-clause (8) (i) now substitutes “for total Deviation Charges” with “with Regional Deviation Charges” and changes “of Discoms” to “by State Discoms and Regional Deviation Charges.” Additionally, Sub-clause (15) in Clause 7 removes the repeated phrase “accordance with.” Sub-clause (23) in Clause 7 has also been updated. The word “Discoms” is now replaced with “Intra State Entities (Excluding RE Generators, Hydro Generators and Open Access Customers).” Similarly, in Sub-clause (23) (a) and Sub-clause (23) (b), “Discom” is substituted with “Intra State Entity (Excluding RE Generators, Hydro Generators and Open Access Customers).”

Sub-clause (23) (c) has been revised to state: “Summary of Reactive Charges payable/receivable by the Intra State entity (Excluding RE Generators, Hydro Generators and Open Access Customers).” This change includes a note indicating that the rates of reactive energy will be those approved by the Commission or specified in the Indian Electricity Grid Code (IEGC) until further orders are issued.

In Sub-clause (24) of Clause 7, the term “Discom” in Sub-clauses (a), (b), (c), and (d) is replaced with “Intra State Entity (Excluding RE Generators, Hydro Generators and Open Access Customers).” The nomenclature of Sub-Clause 26 and Sub-clause (26) (e) is also updated. The term “Discoms” in these sections is replaced with “Intra State Entities (Excluding RE Generators, Hydro Generators and Open Access Customers).”

These amendments aim to clarify and update the terms related to balancing and settlement processes for energy within Madhya Pradesh, ensuring better alignment with current practices and regulations.
