BERC Reserves Order On 10 MW Solar Power Procurement And Draft PPA In Bihar

The Bihar Electricity Regulatory Commission (BERC) has reserved its order in a petition seeking tariff adoption and approval of a draft Power Purchase Agreement (PPA) for the long-term procurement of 10 MW (AC) of solar power in Bihar.

The matter was heard on October 5, 2026, in Case No. 33/2026 at the BERC office at Vidyut Bhawan-II, Nehru Path, Patna. The petition was jointly filed by the Chief Engineer (Generation) of Bihar State Power Generation Company Limited (BSPGCL) and the Chief Engineer (PMC) of Bihar State Power Holding Company Limited (BSPHCL).

North Bihar Power Distribution Company Limited (NBPDCL) and South Bihar Power Distribution Company Limited (SBPDCL) have been named as respondents in the proceedings.

The petition seeks regulatory approval for procuring 10 MW (AC) of solar power on a long-term basis from a grid-connected, ground-mounted solar power project proposed to be established within Bihar. The proposed procurement is intended to support the state’s renewable energy requirements and power procurement planning.

The petition has been filed under Sections 63 and 86(1)(b) of the Electricity Act, 2003. It also relies on the provisions of Chapter 5 of the BERC (Framework for Resource Adequacy) Regulations, 2025, and the BERC (Renewable Purchase Obligation, its Compliance and REC Framework Implementation) Regulations, 2025.

During the proceedings, the Commission referred to the earlier hearing conducted on September 22, 2026. At that hearing, the Commission had raised certain queries concerning submissions filed by the petitioners on September 21, 2026.

In response to the queries, the Chief Engineer (Generation) of BSPGCL submitted revised documents and information through a letter dated October 1, 2026. These revised submissions were subsequently presented and discussed during the October 5 hearing.

The legal counsel representing the petitioners made detailed arguments before the Commission and reiterated the contents of the revised submissions. Senior officials and legal representatives from BSPGCL and BSPHCL were also present during the proceedings.

The three-member BERC quorum comprised Chairman Amir Subhani, Member (Legal) P.S. Yadav, and Member (Technical) Manoj Kumar. After considering the submissions and hearing the arguments from the petitioners, the Commission concluded the proceedings and reserved its order on the petition.

The final decision will determine the regulatory approval for the proposed 10 MW (AC) solar power procurement and the associated draft PPA.
