Tata Power Renewable Energy And Electro Solaire Secures Relief In Dispute With Western Regional Load Dispatch Centre

In a recent legal maneuver, renewable energy giants Tata Power Renewable Energy Limited (TPREL) and Electro Solaire Private Ltd. (ESPL/ENGIE) have succeeded in challenging the restrictions imposed by the Western Regional Load Dispatch Centre (WRLDC) on their solar power projects.

TPREL and ESPL found themselves at odds with WRLDC after the regulatory body issued communications on December 20th and 26th, 2023, limiting the schedule of Gujarat Power Corporation Limitedโ€™s (GPCL) Solar Power Park. These restrictions directly impacted TPREL’s 100 MW Project, diminishing its scheduled power output from 100 MW to 82 MW. TPREL argued that the limitations were unjustified, claiming they were not subject to the Central Electricity Authority (CEA) regulations cited by WRLDC.

Similarly, ESPL voiced concerns over WRLDC’s actions, which restricted their 200 MW solar power project to 164 MW, citing alleged non-compliance with CEA regulations.

WRLDC defended its position, citing commitments made by TPREL and ESPL regarding compliance with CEA standards. They emphasized an undertaking from TPREL regarding additional capacitive compensation, which TPREL allegedly failed to fulfill. WRLDC stressed that compliance with CEA standards falls squarely on the shoulders of solar park developers and solar power developers.

The dispute escalated to the regulatory level, where both parties presented their arguments before the commission. The commission reviewed submissions, including communications, meeting minutes, and responses from both sides.

After careful deliberation, the commission determined that the restrictions imposed by WRLDC were based on CEA directives, which the petitioners were not originally included in. Consequently, the commission stayed the operation of the communications issued by WRLDC concerning TPREL and ESPL’s projects.

The commission’s decision represents a significant victory for renewable energy developers in their ongoing disputes with regulatory bodies. It underscores the critical importance of adhering to technical standards and regulations within the renewable energy sector. This case serves as a reminder to all stakeholders of the necessity of compliance with regulatory requirements. It highlights the crucial role of regulatory bodies in ensuring the stability and security of the energy grid while facilitating the growth of renewable energy projects.
