The Himachal Pradesh Electricity Regulatory Commission (HPERC) has proposed amendments to the existing Model Power Purchase Agreement (PPA) for solar photovoltaic (PV) power projects in the state. These changes aim to streamline the agreement and ensure it aligns with recent regulatory updates and stakeholder feedback.
The primary focus of the proposed amendments is to update the Principal Model PPA, originally finalized in 2016, to better facilitate solar PV power generation projects. This agreement is crucial for setting the terms under which solar power developers and distribution licensees enter long-term power purchase agreements, typically spanning 25 years for projects up to 5 MW.
Several key amendments have been proposed. One significant change is in the definition of “Independent Engineer,” who is now to be appointed jointly by the company and the HPSEBL (Himachal Pradesh State Electricity Board Limited) for synchronization and trial runs. This appointment must occur at least one month before the intended synchronization date, ensuring adequate preparation and coordination between the involved parties.
Another important update involves the synchronization and commercial operation procedures. The new clauses require companies to give the HPSEBL an advance notice of 30 days for synchronization, or 90 days if the synchronization is to occur earlier than scheduled. The amendments also address the interim arrangements for power evacuation if the regular setup is not yet operational. These interim measures are to be mutually agreed upon by both parties, ensuring that power generation can commence without significant delays.
The proposal also modifies the terms related to the trial run and commercial operation of additional capacities. If only part of the installed capacity completes the trial run successfully, similar procedures will apply to the remaining capacity as it becomes ready. This ensures a consistent approach to bringing additional power generation capacities online.
Additional amendments include a reduction in the stipulated hours for certain operational clauses and the introduction of new provisions to account for generation losses due to interruptions occurring during night hours. These changes reflect a more precise and context-sensitive approach to managing the operational aspects of solar PV projects.
The HPERC also introduced miscellaneous provisions to ensure clarity and address specific operational scenarios. For example, the deemed generation benefits now only apply to solar PV projects connected to manned 22 kV and above level substations. This refinement aims to align the benefits more closely with the actual infrastructure and operational capabilities.
Stakeholders are invited to provide their comments and suggestions on these proposed amendments by July 10, 2024. This open consultation process ensures that the final amendments are comprehensive and consider the practical insights of those directly affected by the PPA.
