GERC Allows Petition Withdrawal After Extending Renewable Energy Project Commissioning Timeline In Gujarat

The Gujarat Electricity Regulatory Commission (GERC) has resolved a legal matter related to renewable energy development in the state by allowing M/s Opera Engitech Private Limited to withdraw its petition against Gujarat Energy Transmission Corporation Limited. The decision, issued on April 21, 2026, brings closure to Petition No. 2596 of 2025, which focused on a request for extending the commissioning timeline of a wind-solar hybrid power project.

Opera Engitech had initially approached the Commission seeking an extension of eight months to complete its project. The company also requested protection from any coercive action by GETCO during the pendency of the petition. These concerns included the possibility of cancellation of grid connectivity or reduction in allocated capacity, which could have impacted the viability of the project.

During the course of the proceedings, the situation changed due to a separate order passed by GERC earlier in the year. At a hearing held on April 9, 2026, the petitionerโ€™s counsel, highlighted a significant order issued on January 21, 2026, in another case involving GETCO. This earlier decision had extended the time allowed for commissioning evacuation infrastructure for renewable energy projects of up to 100 MW from 12 months to 18 months.

The Commission had clarified in that order that the revised timeline would apply to all ongoing renewable energy projects that had not yet been commissioned. This broader policy change effectively addressed the concerns raised by Opera Engitech in its petition. As a result, the company informed the Commission that it no longer required any specific relief and sought permission to withdraw its case unconditionally. It also requested a weekโ€™s time to file the formal affidavit for withdrawal.

GETCO, represented did not oppose the request and confirmed that there was no objection to the withdrawal of the petition.

The Commission along with members, noted that the earlier order had already removed uncertainties regarding project timelines and infrastructure readiness. Taking into account the submissions of both parties, the Commission accepted the request and disposed of the petition.

This development reflects how regulatory clarity and timely policy decisions can help resolve disputes and support smoother implementation of renewable energy projects in Gujarat.
