Adani’s 700 MW Hybrid Project Overcomes Legal And Environmental Hurdles To Meet Renewable Goals

In Mumbai, a recent case concerning Adani Electricity Mumbai Ltd. (AEML-D) has brought attention to the complexities of managing large-scale renewable energy projects amidst unforeseen challenges. AEML-D filed a petition for the extension of the Scheduled Commissioning Date (SCOD) for their 700 MW Renewable Energy Hybrid Project due to a series of force majeure events, including the COVID-19 pandemic and environmental regulations.

The project, a significant part of AEML-D’s strategy to meet renewable purchase obligations (RPOs), faced multiple delays. Initial setbacks were due to the COVID-19 lockdowns which impacted the movement and work of labor and the transportation of materials essential for construction. This global health crisis led to a blanket extension of five months granted by the Ministry of New and Renewable Energy (MNRE), acknowledging the pandemic’s impact on ongoing projects.

Further complications arose from legal and environmental challenges. An interim injunction by the Rajasthan High Court on the land allocated for the project halted all construction activities, causing considerable delays. Additionally, the Supreme Court of India mandated the undergrounding of transmission lines in certain areas to protect the Great Indian Bustard, a critically endangered species, which added to the project’s timeline and complexity.

Despite these setbacks, AEML-D sought solutions and adjustments, demonstrating a proactive approach to managing unforeseen challenges. They consolidated multiple agreements into a single Power Purchase Agreement (PPA) to streamline the project’s execution under these complicated circumstances.

The commissioning of the project, though delayed, was a testament to the resilience and adaptability of the involved parties. AEML-D’s efforts to navigate through regulatory, environmental, and logistical challenges underscore the intricate balance required between development and conservation in large-scale energy projects. This case highlights the critical need for flexible regulatory frameworks that can accommodate the unpredictable nature of such extensive projects, ensuring that renewable energy goals can be met even in the face of significant obstacles.
