Azure Power Infrastructure Withdraws Appeal As Dismantling Of Extra 4.33 MW DC Panels Remains Pending: APERC’s Order Issued

During the recent hearing, the Petitionerโ€™s (Azure Power Infrastructure Private Limited) counsel requested permission to withdraw the Original Petition (OP) and associated Interlocutory Applications (IAs). On July 10, 2024, Ms. Shika Sood, representing the Petitioner, informed that her client would disconnect the extra DC panels, which had a capacity of 4.33 MW, on the same day. The Petitioner also committed to dismantling these additional panels within 30 days and sending an email confirming this action on July 10, 2024.

Considering these assurances, the Commission (Andhra Pradesh Electricity Regulatory Commission (APERC)) directed the Respondents to refrain from terminating the Power Purchase Agreement (PPA) if they received the confirmation email on July 10. The Commission also instructed the Petitioner to report on the dismantling progress by the next hearing.

At todayโ€™s hearing, a copy of the minutes from a meeting between the Petitioner and APTRANSCO/APSPDCL officials, held on July 30, 2024, was submitted. The minutes indicated that, as per the instructions from APTRANSCO/APSPDCL officials, the Petitioner had not yet removed or dismantled the panels.

The Petitionerโ€™s counsel reiterated the request to withdraw the OP and IAs. In light of the situation, the OP and IAs were dismissed as withdrawn. The Respondents retain the right to take appropriate action if the additional DC panels are not dismantled. The order was pronounced on August 28, 2024.
