The Gujarat Electricity Regulatory Commission (GERC) has closed a legal case related to a 4.15 MW captive solar project after the petitioner decided to withdraw the matter. The decision was taken during a hearing held in Gandhinagar, where the Commission formally disposed of the petition following the request from the petitioner.
The case, registered as Petition No. 2438 of 2025, was filed by Durga Processors Pvt. Limited, a Surat-based company. The petition was initially submitted under Section 86 of the Electricity Act, 2003, seeking an extension for the commissioning of the projectโs evacuation line, bays, and metering infrastructure connected to the captive solar plant.
According to the petition, the company had requested the Commission to grant a three-month extension from the original transmission capacity allotment date of December 30, 2023. In addition, the petitioner had asked the Commission to direct Gujarat Energy Transmission Corporation Limited (GETCO) not to invoke a bank guarantee of โน20,75,000 during the requested extension period.
However, during the hearing held on February 26, 2026, the case took a different direction. The petitioner was represented by Advocate M. N. Marfatia, who informed the Commission that the solar project had already been successfully commissioned on April 9, 2025. To support this statement, the petitioner submitted a commissioning certificate issued by the Gujarat Energy Development Agency (GEDA) dated May 27, 2025.
The petitionerโs counsel also explained that the petition had been filed due to a misunderstanding related to certain regulatory provisions. The company had mistakenly relied on a tariff order that was not applicable to its project. Since the solar plant had already been completed and commissioned, the petitioner informed the Commission that it no longer wished to continue with the case and requested permission to withdraw the petition unconditionally.
The respondent, GETCO, represented by Advocate Aneesh Bajaj, stated that they had no objection to the withdrawal of the petition. After the hearing, the petitioner submitted a formal affidavit on February 27, 2026, confirming its request to withdraw the case.
The Commissionโs bench, which included Chairman Pankaj Joshi and Members Hiren Shah and Jatin N. Thakkar, reviewed the submissions made by both parties. Considering that the petitioner had clearly expressed its intention not to pursue the matter further and the respondent had no objection, the Commission decided to close the case.
As a result, the Commission officially disposed of the petition as withdrawn on March 5, 2026. The order effectively brings the matter to an end since the solar project has already been commissioned and the petitioner no longer requires regulatory relief.
