The Gujarat Electricity Regulatory Commission (GERC) has announced the Draft Regulations for the amendment of the Terms and Conditions for Green Energy Open Access. These new regulations, known as the Gujarat Electricity Regulatory Commission (Terms & Conditions for Green Energy Open Access) (First Amendment) Regulations, 2024, are set to amend the existing regulations detailed in Notification No. 8 of 2024.
These draft regulations have been issued under the authority of Sections 39, 40, 42, 61, and 86 of the Electricity Act, 2003, along with Section 181 of the same Act, and other relevant powers. They will cover the entire State of Gujarat and will come into effect from the date of their publication in the Official Gazette.
The key changes include amendments to Clause 1 (4) and Clause 17.6 of the Principal Regulations. Clause 1 (4) will now state that the banking charge specified in Regulation 17.6 will be in effect from the date of notification until March 31, 2025, or an earlier date if the Commission issues a separate notification. Similarly, Clause 17.6 (viii) will specify a banking charge of โน1.50 per unit, effective from the date of these regulations until March 31, 2025. After this date, any changes will be notified separately by the Commission.
Stakeholders are invited to submit their suggestions or objections by September 17, 2024. These submissions should be sent to the Secretary of the Gujarat Electricity Regulatory Commission at their office in GIFT City, Gandhinagar. Each submission must include supporting documents, if applicable, and be filed in five copies with an affidavit.
A hearing to discuss these suggestions and objections will be held on September 20, 2024, at 11:30 A.M. at the Commission’s office. This process aims to gather feedback and ensure the regulations reflect the interests and concerns of all stakeholders involved.
