MPERC Proposes Second Amendment To Align Captive Power Verification Rules With National Regulations In Madhya Pradesh

The Madhya Pradesh Electricity Regulatory Commission (MPERC) has issued a draft notification proposing changes to its existing rules for verifying Captive Generating Plants (CGPs) and their users. This proposed update, called the “Second Amendment,” aims to bring the state’s regulations in line with recent changes introduced at the national level.

The need for this amendment comes after the Ministry of Power, Government of India, notified the Electricity (Amendment) Rules, 2026, on March 13, 2026. To maintain consistency with these updated central rules, MPERC has decided to revise certain provisions of its earlier 2023 regulations, which currently govern how captive power plants and their users are verified in Madhya Pradesh.

One of the key features of the draft amendment is the introduction of a clear timeline for the validity of existing verification procedures. A new provision, Regulation 10, has been proposed to include a sunset clause. As per this clause, the current rules and procedures used for verifying the status of captive generating plants and users will remain valid only until March 12, 2026. This means that after this date, a revised or updated framework aligned with national rules is expected to take over.

The amendment also provides clarity on the functioning of the authorities involved in this process. The designated authority and the CGP Status Dispute Resolution Committee, which were formed under the 2023 regulations, will continue to operate only until March 31, 2026. This ensures there is a defined transition period for administrative and regulatory oversight.

Importantly, the Commission has ensured that ongoing legal matters will not be affected by these changes. Any cases that are currently under review or dispute will continue under the existing framework until they are resolved. This step is intended to avoid confusion or disruption during the transition phase.

In addition to these changes, the amendment includes a minor restructuring of the regulation document. The existing Regulation 10 from the original rules will be renumbered as Regulation 11 to accommodate the newly introduced provision. Once finalized, the updated rules will be officially known as the Madhya Pradesh Electricity Regulatory Commission (Verification of Captive Generating Plants and Captive Users) Regulations, 2023, Second Amendment. These regulations will apply across the state and will come into effect from the date they are published in the Official Gazette. The notification has been issued by order of the Commission and signed by Secretary Umakanta Panda.
