CERC Closes Open Access Curtailment Case After Restoration Of Grid Connectivity

The Central Electricity Regulatory Commission (CERC) has disposed of a petition filed by Ambuja Cements Limited concerning the curtailment of power generation from its 300 MW project due to issues related to grid access. The order was issued on June 12, 2026, by a bench headed by Chairperson Jishnu Barua along with Members Ramesh Babu V., Harish Dudani, and Ravinder Singh Dhillon.

The dispute originated when Ambuja Cements approached the Commission seeking relief against restrictions imposed on its access to the Inter-State Transmission System (ISTS). According to the company, the curtailment of its power generation was linked to the non-payment of dues by Essel Saurya Urja Company of Rajasthan Limited to the Central Transmission Utility of India Limited (CTUIL). The restrictions were imposed under the Late Payment Surcharge (LPS) framework, which allows regulatory action in cases of payment defaults.

Ambuja Cements argued that it was operating as a solar power generator within the Essel Solar Park and was not responsible for the outstanding payments owed by Essel Saurya. The company maintained that it should not be subjected to adverse consequences arising from another entityโ€™s financial obligations. In its petition, Ambuja sought a declaration from the Commission stating that it was not liable for the defaults committed by Essel Saurya. It also requested interim relief in the form of immediate restoration of its ISTS connectivity so that power generation and evacuation could continue without interruption.

However, developments after the filing of the petition changed the situation significantly. During the admission hearing held on June 3, 2026, counsel representing Ambuja Cements informed the Commission that the outstanding dues had been cleared after the petition was filed in March 2026. The payment was reportedly made under compelling circumstances, resulting in the restoration of the companyโ€™s grid access.

With the primary issue resolved and the companyโ€™s access to the transmission network reinstated, Ambuja Cements informed the Commission that it no longer wished to pursue the matter. The company requested permission to withdraw the petition while also seeking the liberty to approach the regulator again in the future if a similar issue were to arise.

After considering the submissions made by the petitioner and noting that the restoration of grid access had already taken place, the Commission accepted the request. CERC allowed Ambuja Cements Limited to withdraw the petition and granted it the liberty to seek legal remedies before the Commission in the future, if required.

As a result, Petition No. 226/MP/2026 along with Interlocutory Application No. 72/2026 was officially disposed of as withdrawn, bringing the matter to a close for the time being.
