GERC Reviews Plea For Extension In Commissioning Of 1.1 MW Solar Project

Pankaj Enka Private Limited, based in Surat, Gujarat, filed Petition No. 2469 of 2025 before the Gujarat Electricity Regulatory Commission (GERC), seeking an extension of time for commissioning a 1.1 MW AC capacity solar power project. The petition was filed under Section 86 of the Electricity Act, 2003, along with relevant clauses from the GERC Conduct of Business Regulations, 2004, the Gujarat Renewable Energy Policy, 2023, and the Tariff Order dated August 31, 2024. The petitioner also filed two Interlocutory Applications: one for an interim stay on the encashment of its bank guarantee and another for urgent listing of the petition.

The main request made by the petitioner was to direct the Gujarat Energy Transmission Corporation (GETCO) to allow more time to complete the evacuation line, bays, and metering system needed for the solar power project. The petitioner was represented by Advocate Mr. M. N. Marfatia.

During the hearing on May 27, 2025, GETCO’s counsel, Advocate Mr. Aneesh Bajaj, requested three weeks to file a consolidated reply covering both the main petition and the interlocutory application. This request was not opposed by the petitioner’s counsel. The Commission, consisting of members Mr. S. R. Pandey and Mr. Mehul M. Gandhi, accepted the request and granted three weeks to the respondent to submit its reply, with a copy to be given to the petitioner.

Once the reply is filed, the petitioner will have one week to submit a rejoinder. The Commission instructed both parties to complete their pleadings before the next hearing. As the case had already been listed for hearing, the application requesting urgent listing was deemed satisfied and was disposed of.

The next hearing has been scheduled for June 26, 2025, at 11:30 a.m. The order was issued by GERC on June 3, 2025, from Gandhinagar.
